Legal Fees when Buying and Selling a Property »

  1. The legal fee chargeable by any law firm is fixed under the Legal Profession Act.

  2. The scale fee for buying and/or selling a property is fixed as follows:

    3. Property Value Fee
    First RM100,000.00 1%
    From RM100,000.00 to RM5.0M 0.5%
    From RM5.0M to RM10.0M 0.25%
    above RM10.0M Negotiable

  3. The formula for calculating the above fee for property below RM500,000.00 is as follows:

      4. Property Price x 0.5% + RM500.00 = Legal fee.

Stamp Duty Payable »

  1. In Malaysia, a Purchaser normally has to pay stampduty on the Memorandum of Transfer.

  2. The stamp duty payable is as follows:

    3. Property Value S. Duty
    First RM100,000.00 1%
    From RM100,000.00 to RM500,000.00 2%
    From RM0.5M to RM2.0M 3%
    above RM2.0M 4%

  3. For instance, if the property is RM500,000.00, the stamp duty payable is RM1,000.00 + RM8,000.00 = RM9,000.00.

  4. If the property is RM1,000,000.00, the stamp duty is RM1,000.00 + RM8,000.00 + RM15,000.00 making a total of RM24,000.00.

Disbursement »

Beside stamp duty, most law firm also charge the purchaser the following disbursements:

  1. Stamp duty on Sale and Purchase Agreement @ RM10.00 per set.

  2. Registration fee on Transfer:

    1. WILAYAH PERSEKUTUAN is fixed at RM100.00 which is valid for presentation for three (3) months from the date of the Transfer, after which, a penalty of RM100.00 will be imposed every three (3) months.

    2. NEGERI SELANGOR is fixed as follows:

      Less than RM50,000.00 RM50.00
      RM 50,001.00 - RM200,000.00 RM100.00
      RM200,001.00 - RM0.5M RM200.00
      RM0.51M - RM1.0M RM300.00
      above RM1.0M RM500.00

    Similarly, the instrument is valid for presentation for three (3) months from the date of the Transfer, after which, a penalty corresponding with the registration fees will be imposed every three (3) months.

  3. Search fees:

    1. Wilayah is RM30.00 each for land and private caveat search.

    2. Selangor is RM15.00 each for land and private caveat search.

  4. Other searches:

    1. For individual, a bankruptcy search is RM5.00 per person.

    2. For a limited company, a winding-up search is RM3.00 per company plus RM30.00 for a company search (Registrar of Companies).

  5. Other incidental expenses:
